Terms of Service

About these terms

These Terms of Service (the “Terms”) govern your access to and use of StayWall (the “Service”), operated as a business established in Spain and trading as StayWall. By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

You can contact us at any time at info@staywall.app.

The Service

StayWall provides a subscription-based platform that turns a screen you already own into a live information display for your venue — showing information such as local flights, weather, transport, WiFi access and your own notices. We provide the Service on a software-as-a-service basis and may improve, change or add features over time.

Your account

You must provide accurate information when you register and keep it up to date. You are responsible for maintaining the confidentiality of your login details and for all activity that happens under your account. You must be at least 18 years old and authorised to enter into these Terms on behalf of your venue or business.

Free trial

We offer a 14-day free trial. No payment is required to start the trial. To continue using the Service after the trial ends, you must choose a plan and provide payment details. If you do not subscribe, your displays will stop showing live information when the trial ends.

Subscriptions, billing and payments

Paid plans are billed on a recurring monthly or annual basis through our payments provider, Creem, which acts as the merchant of record for your purchase. This means Creem is the seller of record for the transaction: it processes your payment, handles your payment details, applies any tax due in your jurisdiction, and appears on your receipt and card statement. By subscribing, you authorise Creem to charge your chosen payment method on each renewal until you cancel.

Prices are shown in US dollars and are exclusive of any applicable taxes, which are added at checkout as required. Pricing is metered by the number of venues on your account; adding venues may change the amount you pay. Changes to your plan during a billing period are prorated.

Your subscription renews automatically at the end of each billing period until you cancel.

Cancelling your subscription

You can cancel at any time from your account. Cancellation stops the next renewal; it does not end your access immediately. You keep access to the Service until the end of the billing period you have already paid for — to the end of the current month on a monthly plan, or to the end of the paid year on an annual plan. We will tell you the date your access ends. You may resubscribe before that date and continue with your existing venues and settings.

Because you retain the benefit of the period you paid for, cancellation on its own does not result in a refund of that period. If you would prefer a refund instead of the remaining access, see “Refunds and our money-back guarantee” below.

Refunds and our money-back guarantee

If you are not satisfied with the Service, contact us at info@staywall.app within 30 days of a payment and we will refund that payment in full. This applies to your first payment and to any renewal payment, on both monthly and annual plans. Where a refund is issued, your subscription ends and your account is closed at that point, so a refund and the remaining paid access described above are alternatives rather than cumulative.

Refunds are processed by Creem as merchant of record, back to your original payment method, and the time taken to reach you depends on your payment provider. If you believe you have been charged in error, contact us at info@staywall.app and we will help resolve it.

Statutory rights that apply to you under consumer law, including any right of withdrawal, are not affected by these Terms and apply in addition to the guarantee described above.

Acceptable use

You agree to use the Service lawfully and responsibly. You must not use it to display unlawful, infringing, misleading, defamatory or harmful content, to breach anyone’s rights, to attempt to disrupt or gain unauthorised access to the Service, or in any way that could damage StayWall or its users. We may suspend or terminate accounts that breach these Terms.

Your content

You keep ownership of the content you add to your displays — your logo, notices, venue details and other information. You grant us the limited licence needed to host, process and show that content as part of providing the Service. You are responsible for ensuring you have the right to use the content you upload and that it is accurate and lawful.

Third-party information

Some widgets show information sourced from third-party services, such as flight, weather, transport and local place data (for example, whether a place is open). We treat these sources as reliable and work to keep the information accurate and up to date, but we do not control them and cannot guarantee that the information is always complete, accurate, current or available. It is provided for general guidance only — you and the people viewing your displays should always confirm time-critical details, such as flight times and opening hours, with the official source before relying on them. To the extent permitted by law, we are not liable for any loss arising from reliance on third-party information shown through the Service.

Availability

We aim to keep the Service available and reliable, and displays are designed to keep showing the last known information if connectivity is lost. However, we provide the Service “as is” and do not guarantee uninterrupted or error-free operation.

Limitation of liability

To the fullest extent permitted by law, StayWall is not liable for indirect, incidental or consequential losses, or for loss of profits, revenue or data arising from your use of the Service. Our total liability to you for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits any liability that cannot be limited by law, or affects your statutory consumer rights.

Suspension and termination

You may stop using the Service at any time; cancellation is covered in “Cancelling your subscription” above. We may suspend or end your access if you breach these Terms, fail to pay, or where we are required to by law. On termination, your right to use the Service ends; provisions that by their nature should survive (such as billing owed, acceptable use and liability) will continue to apply.

Changes to these terms

We may update these Terms from time to time. When we make material changes we will update the date at the top of this page and, where appropriate, notify you. Continuing to use the Service after changes take effect means you accept the updated Terms.

Governing law

These Terms are governed by the laws of Spain, and the courts of Spain will have jurisdiction, without affecting any mandatory consumer protection rights you have in your country of residence.
